These Terms of Service ("Terms") govern your access to and use of the Tennis Club Austin website, player platform, ladders, chat features, subscriptions, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to these Terms.
The Platform is a coordination and administration tool for organized tennis play. It does not guarantee match availability, player conduct, specific competitive outcomes, uninterrupted service, court conditions, opponent responsiveness, or any particular fitness, health, or sports result.
You must be at least 18 years old and legally able to enter into a binding agreement to use the Platform. By creating an account or using the Platform, you represent that you meet those requirements. You agree to provide accurate account information, maintain the security of your login access, and use the Platform only for legitimate tennis-ladder participation and related community activity.
You are responsible for activity that occurs under your account, including any communications, scheduling actions, match reports, or subscription actions taken through that account.
Tennis Club Austin provides tools for player registration, season participation, ladder placement, standings, match scheduling, chat, notifications, and subscription management. We may add, remove, or modify features at any time.
Platform features may vary by season, player status, administrative settings, subscription status, or technical availability.
You understand that the Platform coordinates player activity but does not act as a referee, tournament official for every match, court operator, insurer, transportation provider, healthcare provider, or guarantor of player behavior.
Certain Platform features may require a paid subscription. Billing is handled by Stripe or another designated payment provider. By subscribing, you authorize the applicable payment provider to charge the fees and any applicable taxes associated with your selected plan.
You are responsible for keeping your billing information current. Subscription status, cancellation handling, renewal timing, and payment processing may be affected by Stripe's systems and terms. Unless otherwise stated, fees already charged are non-refundable except where required by law.
An active subscription may be required for enrollment in ladder sessions or continued access to certain participation features. If your subscription lapses, is canceled, or cannot be processed, some features may be limited or removed.
You agree to use the Platform in a respectful, lawful, and sportsmanlike manner. You must not:
The Platform helps coordinate matches and maintain standings, but users remain responsible for their own participation, availability, communications, and on-court decisions. You are responsible for confirming match details and for ensuring that reported scores and outcomes are accurate.
We may correct, remove, or review match data, standings, or player records when we reasonably believe the information is inaccurate, incomplete, abusive, or inconsistent with platform rules.
You are solely responsible for selecting courts, confirming scheduling details, paying any facility fees, showing up on time, bringing appropriate equipment, and determining whether a match should proceed safely under the circumstances.
The Platform includes communication tools such as match chat and transactional email notifications. By using these features, you consent to receiving service-related communications necessary to operate your account, manage ladder participation, and coordinate matches.
Chat and match-related email tools are provided only for tennis-ladder communication, including scheduling, court logistics, score confirmation, and related participation matters. They are not provided for social broadcasting, business solicitation, harassment, or the exchange of sensitive personal information.
Replies to certain match-related emails may be ingested into active match chats. You should not include payment data, passwords, identification numbers, medical details, or other sensitive or confidential information in chat messages or match-reply emails.
Match chat is not end-to-end encrypted. Authorized administrators may access, review, preserve, or disclose chat content and related communication records for support, moderation, abuse review, compliance, safety, technical operations, or dispute handling.
Tennis is a physical activity that carries inherent risks, including injury, illness, or property damage. You participate in matches, training, and tennis-related activity at your own risk. Tennis Club Austin does not provide medical advice, coaching guarantees, supervision of every match, or insurance for participants.
You are responsible for determining whether you are physically able to participate and for taking reasonable precautions regarding safety, hydration, weather conditions, facilities, and equipment.
To the fullest extent permitted by law, you voluntarily assume all risks related to travel to and from matches, participation in tennis activity, interaction with other users, use of facilities, court conditions, weather conditions, and any decisions you make based on information provided through the Platform.
The Platform, including its software, visual design, branding, text, layout, and original content, is owned by or licensed to Tennis Club Austin and is protected by applicable intellectual-property laws. Except as needed for normal personal use of the Platform, you may not copy, reproduce, distribute, reverse engineer, or create derivative works from the Platform without permission.
We may suspend, restrict, or terminate access to the Platform at any time if we believe you violated these Terms, created risk for the Platform or other users, failed to maintain an active paid subscription where required, or used the Platform in a fraudulent, abusive, or unlawful way.
You may stop using the Platform at any time. Termination of access does not automatically cancel fees already incurred or erase information we are entitled or required to retain.
We may also issue warnings, temporarily suspend participation, modify ladder records, or permanently ban accounts where necessary to protect platform integrity or community safety.
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Tennis Club Austin disclaims warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
We do not warrant that chat, scheduling, notifications, automations, score reporting, promotions, relegations, rankings, or season transitions will always be error-free, immediate, or available without interruption. Users are responsible for independently confirming important match and safety information.
To the fullest extent permitted by law, Tennis Club Austin and its operators, affiliates, personnel, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the Platform.
To the fullest extent permitted by law, our total liability for claims arising out of or relating to the Platform will not exceed the amount you paid to Tennis Club Austin for the applicable subscription during the twelve months preceding the event giving rise to the claim.
Without limiting the foregoing, Tennis Club Austin is not liable for injuries, illness, death, property damage, lost belongings, facility issues, weather disruption, negligent or wrongful acts of other participants, transportation incidents, communication failures, or any losses arising from your participation in tennis matches or related activities coordinated through the Platform.
To the fullest extent permitted by law, you release and waive claims against Tennis Club Austin and its operators, affiliates, personnel, contractors, and service providers arising out of or related to your use of the Platform, your participation in matches or tennis activities, the acts or omissions of other users, court or facility conditions, weather, travel, scheduling disputes, and ordinary negligence, except where such waiver is prohibited by applicable law.
You agree to defend, indemnify, and hold harmless Tennis Club Austin and its operators, affiliates, personnel, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of your use of the Platform, your participation in tennis activities coordinated through the Platform, your content, or your violation of these Terms or applicable law.
Our separate Rules page is incorporated into these Terms by reference. We may interpret, apply, or enforce those rules in our discretion. Administrative decisions regarding eligibility, reporting, standings corrections, enforcement actions, and platform operations are final except where applicable law requires otherwise.
We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the "Last Updated" date. Your continued use of the Platform after the revised Terms become effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, unless applicable law requires otherwise.
